Cebu City – Gibasura sa Regional Trial Court (RTC) Branch 10 ang gisang-at nga petisyon sa lain-laing grupo batok sa modernization project sa Carbon Market sa Syudad sa Sugbo.

Gipasaka sa mga plaintiffs ang kasong civil, “Nullity of Joint Venture Agreement (JVA) and related Documents, uban sa gipangayo ngadto sa korte nga Writ of Preliminary Injunction, Temporary Restraining Order, Damages ug Mandamus ubos sa Section 2 sa Rule 65.
Sa gipakanaug nga desisyon ni Judge Peras nag sandig kini sa duha ka isyu- kung ang mga petioner “real party in interest” ba o dili ug ang laing isyu nga duna bay ma “suffer nga grave ug irreparable injuries” ngadto kanila o wala.
“Plaintiffs do not have cause of action…There is no grave and irreparable injuries to be prevented”, basi sa hukom ni RTC Branch 10 Presiding Judge Peras.
Alang ni Judge Peras wala ma kompleto ang elemento sa “cause of action” sa maong kasong civil.
“Well-settled is the rule that since action requires, as essential elements,not only a lega right of the plaintiff and a correlative duty of the defendant but also ‘an act or omission of the defendant in violation of said legal right’, the cause of action does not accrue until the party obligated refuses, expressly or impliedly, to comply with its duty,” tipik sa hukom ni Judge Peras.
Sa ikaduhang isyu walak ma kombinsi ang korte sa claims sa mga reklamante.
“Such general claims of loss of livelihood and mental being are natural and logical effect if the plaintiffs have factual right that has been aggrieved due to the Joint Venture Aggeement entered into by the defendants,” dugang pasabot sa desisyon sa korte.
Gipasaka sa mga plaintiffs niadtong Agosto 25, 2021, ang kasong civil, “Nullity of Joint Venture Agreement (JVA) and related Documents, uban sa gipangayo ngadto sa korte nga Writ of Preliminary Injunction, Temporary Restraining Order, Damages ug Mandamus ubos sa Section 2 sa Rule 65.
Naglangkub sa mga mi reklamo sa JVA alang sa Carbon Modernization Project gi representahan sa mosund: Rolando Zozobrado; stall owners Perla M. Eraya, Renato M. Rosito, Lucena A. Obelza, Roland F. Otarra, Crisostomo B. Bacacao, Maria M. Lavares ug taxpayers Aljo B. Tamundo, Bernardo Tamundo, Violeta Rallos, Maria Elena G. Abarrantigue, Pastor Reymundo Gellaogan, Analiza Maglasang, Ricky T. Gomez, Haydee T. Amora, Informal Worker Joseph Tura ug Bato resident Winefredo Miro.

Subingsubing); Wangyu Mambaling Homeowners Association( Luisa Natural); Ermita Fisherfolks Association (Bernardo Tamundo Sr.); Suba Womens Organization( Celia Paden Gely); Cebu Urban Poor Women’s League (Belinda Allere); Panaghugpong sa Kabus nga Taga-Dakbayan (Evelyn Cresencio); Pasil Women’s Organization ( Jesusa Punsua) ug Proper Ermita Homeowner’s Association.
Gireklamo sa lain-laing grupo ang JVA alang sa Carbon Market modernization project tali sa pribadong kompaniya ug sa kagamhanan sa syudad sa Sugbo.
Kini naglangkob sa Megawide Construction Corporation nga gi representahan ni Mr. Louie Ferrer ug Mr. Edgar V. Saavedra; Cebu2World Development Incoporated ug sa habig sa LGU Cebu City ang mitaliwan nga si kanhi Cebu City Mayor Edgar Labella, kanhi Vice Mayor ug karon Mayor Michael Rama, City Adminstrator ug Chairman sa JVA Floro Casas.
Lakip na ang mga sakop sa selection committee nga sila si City Legal Officer Atty Rey Gealon, Marie Vae F. Reyes (City Treasurer), City Public Officer Engr. Kenneth Carmelita Enriquez, (City Planning and Development Officer) Marrieta Labella Gumia (City Budget Officer ), Noel Wenceslao (City Assesor).
Kahinumdumam nga niadtong Enero 11, 2021, misud ug Joint Venture Agreement ang Defendants City ug Megawide Construction Corporation alang sa redevelopment project sa Carbon Market.
Basi sa Technical Working Group (TWG) sa maong Joint Venture Agreement Selection Committee (JVASC) report, ang maong proyekto, I impelemta sa tulo ka hugna.
Ang Phase 1 mao ang development sa Carbon Market Unit1 and 2 ug Campania Maritima; Ang phase 2 mao ang development sa Freedom Park; Phase 3 ang development sa Sitio Bato ug Carbon Market Unit 3.
