Report On Apprehension Of Suspect For Disobedience Of An Agent To A Person In Authority In Relation Of Violation Of EO 69 (Observance Of Curfew), Alarms And Scandals And RA 11332

On January 1, 2021 around 12:35 AM, PMSg. Lyndon M. Gerarcas brought the arrested suspect named Jomar Perez Jhurado, 36 years old, with live-in partner, laborer, and resident of Purok-3, Barangay San Juan, Surigao City for Disobedience of an Agent to a Person in Authority in relation of Violation of EO 69 (Observance of Curfew and RA 11332 that happened around 12:30 AM of January 1, 2020 in Borromeo Street, in front of Surigao City Police Station, Borromeo Street, Surigao City.

The said patrol officer together with his team were conducting checkpoint in Borromeo Street, Barangay Taft, fronting of Surigao City Police Station, Surigao City in consonance with the marching order of President Rodrigo Duterte issued under Proclamation Order Number 922 which declared a State of Public Health Emergency throughout the Entire Philippines in order to decrease the possible outbreak of COVID-19. Hence, the Surigao City and its Province still under General Community Quarantine.

However, on that instance, the said suspect was caught in flagrante delicto riding his motorcycle with galvanized steel (color roof) connected on his tail that produce loud noise on the street causing quite alarming to the public. Also, he violates the Observance of Curfew from 11:00 PM to 4:00 AM.

Arrested suspect was informed of his Constitutional Rights as construed in the Miranda Doctrine and the nature of his arrest to the language known to him and the Anti Torture Act, the same was brought to Surigao City Police Station for documentation and for filing of case.
