General Santos City – Duha Ka tuig nga Supensyon ug walay madawat nga suweldo si General Santos City Regional Trial Court Branch 135 Presiding Judge Oscar Noel Jr.,human gipakanaugan ug hukom nga “guilty of gross ignorance of the law”, may kalabutan sa paggunit sa kaso sa Kapa Community Ministry International Inc. (KAPA).Ang reklamo kontra kay Judge Noel ang gipasaka sa Securities and Exchange Commission (SEC) human gipugngan sa nahisgutang huwes ang ahensiya nga ipatuman ang cease and desist order kontra sa mga opisyal ug ahente sa KAPA.
Niadtong tuig 2019 nagpagawas ug temporary restraining order (TRO) ug writ of preliminary injunction si Noel pabor sa grupo nga nalambigit sa P50-billion Ponzi investment scheme. Pinasubay sa 11-ka pahina nga desesyon nga gisulat ni Associate Justice Antonio Kho Jr., Gipaburan sa Korte Suprema ang panig sa SEC.
“Based on the foregoing, respondent should have refrained from acting on the subject case—as what the Presiding Judge of RTC Branch 58 did. Despite these, respondent still issued a 20-day TRO, and later on, a WPI in KAPA’s favor and against the CDO issued by the SEC, a co-equal body,” batay sa nabanggit na January 23, 2023 promulgation ng SC 2nd Division at naipalabas sa publiko nitong June 13.
Gitumbok pa nga korte suprema nga duha na ka higayon nga napatawan si Judge Noel sa “administratively liable” gumikan sa “gross ignorance of the law”, sa wala pa ang kontrobersiyal nga kaso sa KAPA.
“This goes without saying that should respondent be found administratively liable for the same offense in the future, then the Court might no longer temper the penalties that may be meted on him,” ang babala ng SC. (Rey G. Ombaña)
