Cebu City – Pormal nang pasakahan ug kaso sa Department of Justice (DOJ) si kanhi Mactan-Cebu International Airport Authority (MCIAA) general manager Steve Dicdican ug laing 15, lakip na ang 11 ka mga langyaw, gumikan sa pasangil sa pag award ug P14.4-billion concession deal ngadto sa non-fully owned Filipino consortium.
Gibutyag ni DOJ Undersecretary Emmeline Aglipay-Villar nga ang panel of prosecutors sa ilang National Prosecution Service (NPS), basi sa 48 ka pahina nga resolution, pinitsahan ug Oktubre 8, mi rekomenda sa pag file ug duha ka information sa duha ka lahi nga Anti-Dummy Law batok kang Dicdican ug laing 15 ka mga indibidwal.
Ang DOJ-NPS miila sa mga respondents sa unang information nga sila si Andrew Acquaah-Harrison, Ravi Bhatnagar, Ravishankar Saravu, Michael Lenane, Sudarshan MD alias Sudarshan Madhav Doddathota, Kumar Gaurav, Magesh Nambiar alias Magesh Perayil Kanneth, Ragehs Madan, kinsa giingong mi act isip executive officers, managers and/or employees sa GMR-Megawide Cebu Airport Corporation (GMCAC), “in the guise of being advisors, experts and/or technical personnel.”

Ang mga foreign nationals, kinsa giingong wala maghupot sa qualification nga gikinahanglan sa Constitution o existing laws, gidudahang gitugtan sa pag “acquire, use, exploit or enjoy a right, franchise, privilege, property or business, kansang katungod pag exercise ug pag enjoy gilatid sa Batakang Balaud o sa existing laws ngadto lang sa citizens of the Philippines.
Ubos sa konstitusyon ug sa balaud ang mga Filipino lang ang dunay katungod sa pag intervene sa management, operation, ug administration o control sa GMCAC, usa ka public utility corporation nga dunay government franchise pag operate ug pag maintain sa MCIA.
Si Dicdian maoy bugtong respondent sa ikaduhang resolution.
Sa wala pa ang kamanduan sa preventive suspension nga unom ka buwan ni Dicdican, gidudaha siya nga “knowingly assisted, aided and abetted the commission of the violation of the Anti-Dummy Law.
Ang Anti-Dummy Law nagdili sa pamaagi sagad niini gibuhat sa mga langyaw aron paglikay sa nationality restrictions sa Pilipinas.
Sa 16 ka mga respondents, walo niini mga Indian nationals, usa ka Singaporean, usa ka Irihs ug usa ka Ghanaian.
Ang GMCAC, pribadong kompaniya nga nagduma sa terminal operations ug ubang related areas sa MCIA, consortium kini tali sa Filipino company nga Megawide Construction Corporation ug ang foreign GMR nga grupo.
Naglangkob sa concession mao ang pag expand ug pag operate sa MCIA nga naglakip sa pagtukod ug bag-ong passenger terminal uban sa gikinahanglang infrastructure facilities; pag rehabilitate ug pag expand sa kasamtangan nga terminal uban sa associated infrastructure ug facilities; pag install sa required information technology ug ubang equipment nga haum sa operations; ug operation and maintenance sa duha ka passenger terminal sud sa concession period.
Planong pagpalagpot
