Comelec summons BBM over petition to cancel his 2022 presidential candidacy

The Commission on Election (Comelec) has started tackling the pending petition to cancel the Certificate of Candidacy (COC) of presidential aspirant Ferdinand “Bongbong” Marcos Jr. by summoning the camp of the former senator.  

Comelec spokesperson James Jimenez said the subpoena was issued on Nov. 11, 2021 to the camp of Marcos. . 

“The summon was issued yesterday, and is expected to be served today. We are awaiting proof of service,” Jimenez said in a brief statement issued last Friday.

“Upon receipt of the summons, the respondent will have five day to file an answer,” he added.   

Once the said answer is submitted, Comelec can finally hold a pre-conference meeting where lawyers of both petitioner and respondent will “face off.” 

“After that, they will submit written memoranda, three days after that point, after which they will be considered for resolution,” Jimenez said.  

The poll official said it may take more than 8 days before the case is resolved since the timeline for the resolution of the case will depend on when the concerned party will receive the summons as well as when Comelec will schedule the date of the pre-conference meeting.  

Marcos is currently facing two petitions for the cancellation or denial in due course of the Certificate of Candidacy (COC) for his court conviction for violating the  National Internal Revenue Code (NIRC) as well as falsifying the content of his COC. 

One of the said petitions was already raffled to the Comelec Second Division, which includes Comelec commissioners Socorro Inting and Antonio Kho Jr.
