Pagadian City – Around 6:30 A.M. of June 2, 2021 at Baloyboan COMPAC, National Highway, Barangay Buenavista, Pagadian City by PNP personnel of this station led by PLT VENUS J DELA PEÑA, Officer of the Day (OD) with PCMS Jeffrey Dela Cruz Casimiro, Baloyboan COMPAC Team Leader under direct supervision and control of PLTCOL PARSON J ASADIL, COP in support with Zamboanga Del Sur Provincial Mobile Force Company (PMFC) led by PLT JESS RICK T MENDOZA, Team Leader and personnel of 53rd IB, GUIPOS led by PFC Felizardo G Delos Reyes which resulted to the arrest of one Almujir Jul Masihol, 26 years old, male, Filipino, married, fisherman and a resident of Phase 1, Barangay Kasanyangan, Zamboanga City; Alwaler Gadjamil Jakirani, 22 years old, male, Filipino, single, jobless; and Al-Shaiff Gadjamil Jakirani, 20 years old, male, Filipino, single, student and both residents of Poblacion, Alicia, Zamboanga Sibugay and confiscation of Nineteen (19) Suspected Smuggled Cigarettes boarded on Alpine White Isuzu Highlander Wagon vehicle bearing Plate No. RED 526 driven by Almujir Jul Masihol which is now inventoried by the IOC and further requested the personnel of the Bureau of Internal Revenue (BIR) for inventory to determine the tax due in relation to R.A.10963 (“ Tax Reform for Acceleration and Inclusion [TRAIN]”).
The interception was made when the aforesaid joint PNP personnel conducted checkpoint operation in relation to the new E.O. No. 26, Series of 2021 placing the entire City of Pagadian under Modified Enhanced Community Quarantine (MECQ) to prevent the spread of COVID-19 virus/disease. Thus, upon checking the aforesaid vehicle and while downing the glass window it was found out in plain view.
The presence of Suspected Smuggled Cigarettes that prompted the operating team to hold the said vehicle.

On the other hand, a black sling bag named (Santa Barbara) was seen on a dash board of said vehicle and upon asked by the team what was the content, the suspect Almujir Jul Masihol, (DRIVER) answered in good faith that the content was a Caliber .45 pistol firearm (REMINGTON) with S.N. 518163 and voluntarily acknowledged himself that he was the owner/holder of the same firearm. Thus, the joint team asked the driver of any pertinent documents regarding the possession of said firearm as well as the suspected smuggled cigarettes loaded in the same vehicle but the driver only presented original copy of Mission Order issued by LTC MONTANO B ALMODOVAR, GSC (INF) PA, JTFS2 of HEADQUARTERS JOINT TASK FORCE SULU but he is not member of Philippine Army while his companions failed also to show any pertinent documents that prompted the team to place them under arrest for violation of Sec. 254 of R.A. 8424 as amended by Sec. 76 of R.A. 10963 in relation to Sec. 145 of R.A. 8424 and Violation of R.A. 10591 against the driver and informed of their individual statutory rights under “Miranda Warning” doctrine and further brought to Pagadian City Police station together with the aforesaid vehicle boarded with confiscated smuggled cigarettes with an estimated amount of more or less Five Hundred Thousand Pesos (₱ 500,000.00) for documentation and proper disposition while an inquest case was being prepared.
