Tobacco Online Sellers Urged To Ensure Buyers Are Not Minors

Davao City:  The Davao City Vices Regulation Unit (VRU) has reminded all online sellers of tobacco products to be responsible that their buyers or clients are not minors.

Dr. Ashley Lopez, the Head of VRU, said tobacco product sellers resort to online selling for the convenience of clients during the coronavirus pandemic.

He, however, expressed concern that minors who are exposed to social media, will have easy access to tobacco products if left unchecked.

“The seller should have the obligation to remind the public about the harmful effects of smoking. There is a responsibility because they must regulate the selling. We know that this can harm our health especially young people because they are more likely to get addicted to tobacco products. And they should also know that selling cigarettes to minors is prohibited,” Lopez said.

Lopez reminded sellers of the sanctions if they are selling tobacco products minors. He said they will be punished according to the RA 9211 or the Tobacco Regulation Act, which states that “it shall be unlawful for any retailer to sell tobacco products to any minor, as well as for a minor to sell, buy and smoke tobacco products”.

According to Sec. 31 (b) of RA 9211, any person or any business entity or establishment selling to, distributing or purchasing a cigarette or any tobacco products for a minor shall be fined the amount of not less than P5,000 or an imprisonment of not more than thirty (30) days, upon the discretion of the business licenses or permits in the case of a business entity or establishment.

Lopez also advised sellers to secure a business permit before they could sell cigarettes, e-cigarettes, and other tobacco products.

The VRU chief said his office is coming up with action plans about irresponsible online sellers and is currently active in online surveillance to ensure that the sellers have the necessary permits to operate.

“I would like to appeal to the sellers to be responsible enough. We are not prohibiting you from selling, from making a living. Just be responsible enough so you will not affect children,” she said. CIO
