Comelec adopts new restrictions regarding party-list nominees

The Commission on Election (Comelec) adopted new restrictions regarding party-list nominees following the controversy surrounding the Duterte Youth party-list during the 2019 polls. 

“If a nominee withdraws his acceptance, he is no longer eligible to be re-nominated by the same party or be nominated by other parties,” Comelec said in a statement. 

To recall, Duterte Youth drew criticism after it replaced the line up of its nominees at least three times after its main nominee, National Youth Commission Commissioner Ronald Cardema faced disqualification petitions.

Other issues raised against the party-list was its failure to comply with the requirement for it to publish its nominees before the deadline set by Comelec. 

Despite the petitions filed against Duterte Youth, Comelec allowed the party list to be still represented in Congress.

In attempt to prevent the same issue during the 2022 National and Local elections, the poll body issued its Resolution No. 10690, which stressed party list  must publish their substitute nominees before they are deemed as valid by the Commission.

The publication must happen five days from the filing of the list of substitute nominees to Comelec. 

“The party shall submit proof of publication of its new list of nominees with the Law Department within three days from completion of the said publication,” Comelec said. 

“No substitution shall be valid without compliance with the requirements on publication and submission of proof thereof,” it added.
