Cebu City – Mohangyo ang Cebu City Council kang President Ferdinand “Bongbong” Marcos Jr. ug sa Department of Trade and Industry (DTI) nga mag establish ug Construction Industry Arbitration Commission (CIAC) branch office sa lain-laing mga rehiyon sa nasud, lakip na sa Syudad sa Sugbo.
Kini human ang 16th Council midason sa motion nga giduso ni Majority Floor Leader Councilor Jocelyn Pesquera, sa privilege speech, atol sa regular session sa konseho, Miyerkules, Agosto 10, 2022.
Mi uyon sab ang konseho sa Syudad pag hangyo sa CIAC pag accredit ug dugang arbitrators gikan sa mga Probinsya sama sa Probinsya sa Sugbo ug mga syudad gawas sa Manila, sam sa syudad sa Sugbo pag handle sa mga kaso sud sa ilang lokalidad.
Si Pesquera, sa iyang privilege speech, mituki sa mga challenges nga giatubang sa mga local property owners developers ug constractors pag resolba sa construction ug contract disputes gumikan kay walay CIAC arbitration office o branch sa Sugbo.
Ang CIAC natukod pinaagi sa Presidential Decree no. 1746 nga gi issue ni late president Ferdinand Marcos, usa ka attached agency sa kaniadtong \Ministry, ug karon DTI.
Dunay kini original, exclusive jurisdiction sa mga disputes nga gumikan o dunay koneksyon sa kontrata nga gikasabutan sa mga parties nga nag lambigit ug construction sa Pilipinas, “whether the disputes arise from, before, or after the completion of the contract or after the abandonment or breach thereof.”
Matod ni Pesquera nga ubos sa CIAC revised rule of procedure nga nag govern sa construction arbitration, “any party to a construction contract desiring to avail of arbitration shall file its request for arbitration in the prescribed form and number of copies to the Secretariat of CIAC.”
Alang ni Pesquera nga ang location sa office of the Secretariat nga nahimutang sa Metro Manila, napamatud-an nga “detrimental” sa interest sa construction companies, property owners, developers, bisan ang local governmen units, nga naa sa lain-lang bahin sa nasud, sama sa Syudad sa Sugbo.
“These disputes may involve government or private contracts. The CIAC office is located in Makati City, Metro Manila and they do not have regional offices,” matod ni Pesquera.
“So, kung naay mga kaso kabahin sa construction, apil na ang mga construction contracts that we have, ang kaso adto didto i-file sa Manila. Adto i-hear, and then, even ang kanang mag construct ka sa imong gamay nga balay (nga muingon ta’g socialized housing), kung naa kay problema sa imong contractor, adto nimo i-file in Metro Manila,” dugang sa konsehal.
Nagkanayon si Pesquera nga nga dunay panginahangan sa nahisgutang government entity pag establish ug mga branches sa ubang bahin sa Syudad, gawas sa Metro Manila, aron ma avail sa tanan ang ilang mga services. (Jhon Tadlip)
